NOTICE OF PERIODIC REVIEW OF REGULATION PURSUANT TO EXECUTIVE ORDER 21 (02)

Pursuant to Executive Order Number 21(02), the Virginia Department of Transportation has scheduled the regulation listed below for review. The purpose of the review is to determine whether the regulation should be amended or retained as written. If any changes are deemed necessary, VDOT will file the appropriate documentation as required by the Administrative Process Act (APA) §2.2-4007 et seq. of the Code of Virginia).

VDOT seeks public comment regarding the following questions:

1. Does the regulation meet the following goals?
- Provide a fair process for the promulgation of regulations;
- Ensure that the public is informed of any new regulations or amendments to existing regulations and has opportunity to participate in the regulatory process;
- Comply with statutory and procedural requirements concerning public participation; and
- Protect the public’s health, safety, and welfare with the least possible cost and intrusiveness to the citizens and businesses of the Commonwealth

2. Is the regulation clearly written and understandable?

Subject: Establishes the manner in which VDOT will solicit public input in the development of regulations promulgated under the Administrative Process Act.
