This regulatory action is necessary to bring state Child Care Subsidy Program requirements into compliance with § 63.2-1720.1 of the Code of Virginia necessitated by legislation passed in the 2020 General Assembly (Chapter 936, SB668). Changes to this regulation require certain child care providers, applicants for employment, employees, applicants to serve as volunteers, or volunteers thereof to submit to background checks that include a criminal history record information check and sex offender registry check in any state in which the applicant has resided in the preceding five years.
