12VAC5-410 governs the licensure of hospitals in Virginia. This regulatory action seeks to repeal the regulation and create two new chapters that address inpatient hospitals and outpatient surgical hospitals separately. The new chapters will contain updated regulatory language that better conforms to the language in the Code of Virginia and the Virginia Register of Regulation’s Form, Style and Procedure Manual for Publication of Virginia Regulations, to provide updates that better reflect current industry practices, and to consider opportunities for regulatory reduction where possible, in accordance with Executive Order 19 (2022). The goal of this regulation is to protect the health and safety of the public; therefore the regulatory language must be clear and easy to understand and implement by both regulants and the Virginia Department of Health. The Virginia Department of Health intends to achieve this goal through extensive and comprehensive adjustments to the current regulations. This action may address comments received during the public comment period for this NOIRA and subsequent stages of this action, as well as comments received during the public hearing.
